the Under Secretary of Commerce for Oceans and Atmosphere

AUTHORITY DELEGATED TO:
 
NOAA Chief Administrative Officer (CAO), who has assumed the real property functions and responsibilities formerly vested in a position titled Chief Financial Officer/Chief Administrative Officer, NOAA Office of Finance and Administration (CFO/CAO); and those responsibilities formerly vested in positions titled Directors, Administrative Support Centers (ASC Directors).

SOURCE OF AUTHORITY:

Department Organization Order (DOO) 25-5, Section 3.01; Department Administrative Order (DAO) 201-44; and Department of Commerce (DOC) Real Property Management Manual (RPMM), Chapter 2, ¶¶ 2.3.2(d), 2.3.3(a)(3), 2.3.3(b).
 

RESERVED AUTHORITY: Subject to reservations concerning authorities delegated to the Under Secretary of Commerce for Oceans and Atmosphere, or concerning the Under Secretary’s authority to redelegate, contained in DOO 25-5; DAO 201-44; and RPMM, Chapter 2, "Authorities, Roles and Responsibilities."
 
AUTHORITY TO DO WHAT:
 
To the extent such authority has not been reserved by the Secretary, Department of Commerce Assistant Administrator for Administration/Chief Financial Officer or by other means, (RPMM Chapter 2, ¶¶ 2.3.1), the following authorities for Real Property Management are delegated:

(1) Acquire real property, or any interests therein (RPMM, Chapter 2, ¶ 2.3.2(a)(1))

(2) Undertake new construction (including site selection, preparation, and utilities provision), repairs, alterations, improvement, and restoration projects that have been approved and funded through NOAA’s capital investment program (RPMM, Chapter 2, ¶ 2.3.2(a)(2)).

(3) Perform operation, maintenance, and related facilities management activities (RPMM, Chapter 2, ¶ 2.3.2(a)(3)).

(4) Assign, transfer, or dispose of real property, or any interests therein (RPMM, Chapter 2, ¶ 2.3.2(a)(4)).

(5) Pursuant to the authority vested under DOO 10-5, grant easements and other rights of access to real property under NOAA’s control or jurisdiction, subject to requirement that easement documents be reviewed and approved by DOC's Office of General Counsel prior to execution (RPMM, Chapter 2, ¶ 2.3.3(a)).

(6) Lease unimproved land, building space, and land incidental thereto, and space on man-made structures, such as towers, to the extent authorized in 41 CFR 102.73 (RPMM, Chapter 2, ¶ 2.3.3(b)(1)).

(7) Transfer excess real property, to the extent authorized in 41 CFR 101.47.2 and 102.75 (RPMM, Chapter 2, ¶ 2.3.3(b)(2)).

(8) Act as a disposal agency for surplus real property to the extent authorized in 41 CFR 102.75 (RPMM, Chapter 2, ¶ 2.3.3(b)(3)).

(9) Negotiate and execute leases or other agreements for facilities for no cost or nominal consideration to the extent authorized in 41 CFR 102.73 (RPMM, Chapter 2, ¶ 2.3.3(b)(4)). [NOTE: Facilities acquired under this authority must meet the same requirements and standards for facilities acquired competitively. Only Warranted Real Property Contracting Officers may execute such leases or agreements.]

(10) Abandon, destroy, or donate to public bodies, Government-owned real property to the extent authorized in 41 CFR 102.75 (RPMM, Chapter 2, ¶ 2.3.3(b)(5)).

(11) Provide technical guidance within NOAA on matters related to real property acquisition, utilization, management, and disposal (RPMM, Chapter 2, ¶ 2.4.3(a)(1)).

(12) Implement Departmental policies and procedures, and develop NOAA-wide policies and procedures to ensure the efficient, safe, and economic use of NOAA resources (RPMM, Chapter 2, ¶ 2.4.3(a)(2)).

(13) Analyze and coordinate operational aspects of NOAA’s facility management program, including execution of Executive Order 13327, Federal Real Property Asset Management, both in the National Capital Region and in the field (RPMM, Chapter 2, ¶ 2.4.3(a)(3)).

(14) Serve as the functional counterpart to DOC’s Director, Office of Administrative Services, relative to policy or operational issues concerning acquisition, management, utilization, and disposal of real property (RPMM, Chapter 2, ¶ 2.4.3(a)(4)).

(15) Serve as the functional interface to other Departmental Operating Units on real property issues for those Operating Units/locations that NOAA services (RPMM, Chapter 2, ¶ 2.4.3(a)(5)).

(16) Manage NOAA's major construction project program and NOAA’s facility maintenance budget (RPMM, Chapter 2, ¶ 2.4.3(a)(6)).

(17) Review and approve all interagency service agreements, Memoranda of Understanding (MOUs) or Memoranda of Agreement (MOAs) involving use of real property between NOAA and other federal agencies, subject to requirement for concurrence by DOC's Office of General Counsel (¶ 2.4.4(a)(19 and 21)).

(18) Approve the temporary use (outgrant) of NOAA facilities by non-federal parties (RPMM, Chapter 2, ¶ 2.4.4(a)(26)).
 

EFFECT ON OTHER
DELEGATIONS:
 
The following delegation documents are rescinded: Memorandum dated May 9, 1996, redelegating certain authority from the NOAA CFO/CAO to the ASC Directors; NOAA Circular 88-11 (NOAA Directives Manual 05-20); NOAA Circular 79-65 (NOAA Directives Manual 05-99).
