1. NOAA shall comply with the following DOC FOIA
fee regulations:
- (a) Charges are to be made according to attachment
2 of this Order. There is no charge for processing
FOIA requests of $20 or less. Requesters must
authorize all fees before the FOIA request
is processed.
- (b) If estimated costs exceed the authorized
amount specified in the request, or if costs
exceed $250, the NOAA official considering
the request will inform the requester of the
estimated cost and that prepayment will be
required before searching or copying of records
is begun.
- (c) FOIA responses shall clearly indicate
costs to the requester and request that payment
be made by check or money order payable to
the Treasury of the United States. If the requester
mails the payment to the action office, notify
the NOAA FOIA Officer when payment is received.
This requirement is for NOAA and DOC reporting
purposes. Payments shall be sent to the following
address: NOAA Freedom of Information Officer
(OA332), National Oceanic and Atmospheric Administration,
6010 Executive Boulevard, Room 714, WSC-5,
Rockville, Maryland 20852.
- m. Item 13 - Tolling of Time Provisions
- Completed by action office upon receipt of the
request.
- n. Item 14 - Initial Determination
- Completed by action office authorizing official.
1. If an authorized official proposes to deny a request
for information, he/she must coordinate the proposed
denial with the NOAA FOIA Officer. After coordination,
the determining official shall send a signed letter
to the requester that includes the following:
- (a) the specific exemptions which support
the reasons for denial and explain why they
apply;
- (b) a statement explaining why a portion
of the information is being provided when another
portion is not (in the case of a partial denial);
- (c) a statement of the right to appeal to
the Assistant General Counsel for Administration,
DOC, within thirty (30) days of the receipt
of the denial; and
- (d) a statement that the appeal shall include
a copy of the original request, the initial
denial, requester's reasons why the records
shall be made available, and reasons why the
initial denial is believed to be in error.
2. Send copies of this signed denial letter along
with the original request to the NOAA FOIA Officer
and the Office of General Counsel.
- o. Item 15 - Collectible Costs per Fee

- p. Item 16 - Non-collectible Costs
