LABOR-MANAGEMENT RELATIONS PROCEDURES

SECTION 1. PURPOSE.

The attached document sets forth the policies and procedures to be followed by National Oceanic and Atmospheric Administration (NOAA) management officials to assist them in meeting their responsibilities under the Federal Service Labor-Management Relations Statute (5 U.S.C. 71) and Department Administrative Order (DAO) 202-711, Labor-Management Relations.

SECTION 2. SCOPE.

The policies and procedures detailed in the attachment apply to all levels of management in all organizational components of NOAA.

SECTION 3. AUTHORITIES AND RESPONSIBILITIES.

The authority to make decisions concerning Labor-Management Relations matters rests with Line Office management. The decision-making process must provide for the advice, counsel and guidance from knowledgeable Department, NOAA, and Administrative Support Center (ASC) staff Labor-Management Relations experts. The following structure has been developed:

o the designation by each headquarters Line Office of a labor relations contact point,

o the designation by each ASC of one or more Labor-Management Relations Specialist(s),

o within the NOAA Personnel Division, the designation of a Labor Relations Officer,

o liaison, as necessary and appropriate, with DOC Office of Personnel and Civil Rights/Personnel Division (for issues with Department-wide implications) and Office of General Counsel.

SECTION 4. LABOR-MANAGEMENT RELATIONS PROCEDURES.

The attached Labor-Management Relations document is used by NOAA to disseminate NOAA Labor-Management Relations policies and procedures throughout the Bureau. It is to be used as a ready-reference for specific concerns that arise in Labor-Management Relations. For topics covered in this document, consult the Table of Contents provided.

SECTION 5. EFFECT ON OTHER ISSUANCES.

This directive supersedes Chapter 09, Labor-Management Relations, of the NOAA Personnel Handbook; and NOAA Circulars 74-36, 79-19 and 82-09, all filed with Chapter 09 of the NOAA Personnel Handbook.
